By downloading or using the MATCHUPS app, you agree to these Terms of Service ("Terms"). If you don't agree, don't use the app.
1. Eligibility
You must be at least 13 years old to use MATCHUPS. By using the app, you confirm you meet this requirement. We do not knowingly collect information from children under 13.
2. Your Account
You're responsible for maintaining the security of your account and for all activity that occurs under it. Provide accurate information when registering and keep it up to date.
3. AI Avatar Feature
This section is important. Please read it.
When you submit a photo for avatar generation, your image is transmitted to third-party AI service providers, currently FAL.ai and Remove.bg, solely to generate your avatar. By using this feature, you consent to your photo being sent to and processed by these providers. Each operates under its own privacy policy.
- This feature is optional. You can use MATCHUPS without it.
- Only submit photos of yourself that you have the right to use.
- Do not submit photos containing minors.
- We do not use your photos to train AI models.
- You may delete your avatar at any time from your profile settings.
4. User Content
When you upload photos or videos ("Moments") to MATCHUPS, you retain ownership of your content. You grant us a limited license to store and display it within the app to operate the Service.
You agree not to upload content that is illegal, obscene, defamatory, or that violates anyone else's rights. We may remove content that violates these Terms.
5. Competitions and Tournaments
You agree to report accurate scores and participate in good faith. If you create a tournament, you're responsible for communicating its rules to participants. We are not responsible for disputes between users arising from competitions.
6. Subscriptions
MATCHUPS offers a free tier and may offer a paid subscription tier. Paid subscriptions are billed through the Apple App Store and auto-renew unless cancelled at least 24 hours before the renewal date. Refunds are subject to Apple's policies.
7. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose.
- Falsify scores, handicaps, or any game data.
- Reverse engineer or tamper with the app.
- Scrape, harvest, or collect other users' data.
- Impersonate any person or entity.
8. Intellectual Property
All MATCHUPS branding, design, and features are owned by Matchups LLC. "MATCHUPS" is a trademark of Matchups LLC. We grant you a limited, non-transferable license to use the app for personal, non-commercial purposes.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI AVATARS WILL ACCURATELY REPRESENT YOUR LIKENESS, OR THAT GOLF COURSE AND GPS DATA WILL BE ACCURATE AT ALL TIMES.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MATCHUPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR $50.
11. Governing Law
These Terms are governed by the laws of the State of Georgia. Any disputes shall be resolved exclusively in the courts of Georgia.
12. Changes
We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance. We'll notify you of material changes through the app or by email.
